Terms of Use

These Terms of Use apply to HushCalc, FocusFine, Worth the Hours, Paper Quest, other apps published by Noia Software that link to these terms, and the Noia Software website.
1. Accepting these terms
By downloading, accessing, or using a Noia Software app or website, you agree to these terms. If you do not agree, do not use the applicable app or website. If you use an app on behalf of an organization, you confirm that you have authority to bind that organization.
2. App Store license
Apps distributed through Apple's App Store are licensed, not sold. Unless a custom license agreement is shown for an app in the App Store, Apple's Standard Licensed Application End User License Agreement governs the license to that app. These Terms of Use supplement that agreement. If these terms conflict with Apple's Standard EULA on a matter covered by that EULA, the Standard EULA controls.
3. Permission to use the apps
Subject to these terms and the applicable app-store rules, Noia Software gives you a limited, personal, non-exclusive, non-transferable, and revocable right to use the apps for lawful purposes on devices you own or control. You may not copy, sell, rent, sublicense, distribute, reverse engineer, interfere with, or create derivative works from an app except where applicable law expressly permits it.
4. Your content and responsibilities
You retain ownership of files, books, photos, videos, records, and other content you place in an app. You are responsible for having the rights needed to use that content and for keeping lawful backups when appropriate. You must not use the apps to violate law, infringe another person's rights, distribute malicious software, defeat security controls, or harm other people or systems.
5. Privacy and device permissions
How each app handles information is described in its app-specific privacy policy. Features may require permissions such as notifications, Screen Time access, photo-library access, local-network access, or device authentication. You can manage many permissions in your device settings, although disabling one may prevent the related feature from working.
6. Purchases and payments
Paid downloads, in-app purchases, subscriptions, or optional paid commitments offered through an app are processed by Apple or the relevant app-store provider. Their billing, cancellation, and refund rules apply. Noia Software does not receive your full payment-card details. Prices and available features may change, but changes will not alter a completed one-time purchase retroactively.
7. App-specific limitations
HushCalc is a privacy utility, but no security system can guarantee protection against every loss, device compromise, forgotten credential, or user action. Worth the Hours provides estimates for personal perspective and is not financial, tax, employment, or investment advice. FocusFine can support attention and commitment but does not guarantee productivity or a particular outcome. Paper Quest requires you to have the necessary rights to books and documents you import.
8. Availability, updates, and changes
Apps and features may change as products improve. Noia Software may add, update, suspend, or discontinue a feature or app, including when required for security, legal, technical, or app-store reasons. Continued use may require installing an update. We will take reasonable care to avoid unnecessary loss of locally stored data, but you remain responsible for backups available to you.
9. Third-party services
Some features rely on Apple services or other third-party platforms, such as the App Store, device notifications, Screen Time frameworks, or operating-system sharing tools. Those services are governed by their own terms and privacy practices, and their availability is outside Noia Software's control.
10. Intellectual property
The apps, website, designs, software, trademarks, and original content provided by Noia Software are owned by Noia Software or its licensors and are protected by applicable intellectual-property laws. These terms do not transfer ownership to you.
11. Disclaimers
To the fullest extent permitted by applicable law, the apps and website are provided “as is” and “as available.” Noia Software does not promise uninterrupted or error-free operation, compatibility with every device or file, or that every feature will remain available. Nothing in these terms excludes warranties or rights that cannot legally be excluded, including mandatory consumer protections.
12. Limitation of liability
To the fullest extent permitted by law, Noia Software is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, opportunity, or goodwill arising from use of an app or website. This limitation does not apply where liability cannot legally be limited, including liability for fraud, intentional misconduct, or personal injury caused by negligence where applicable.
13. Suspension and termination
You may stop using an app at any time. Your right to use an app ends if you materially breach these terms. Provisions that logically continue after termination—including ownership, disclaimers, liability limits, and dispute terms—remain in effect.
14. Governing law and disputes
These terms are governed by the laws of Portugal, without depriving consumers of mandatory protections provided by the law of their country of residence. Courts in Portugal will have jurisdiction except where applicable consumer law allows or requires you to bring a claim in another court.
15. Changes to these terms
Noia Software may update these terms to reflect product, legal, or operational changes. The effective date will be updated when changes are published. If a change materially affects your rights, reasonable notice will be provided through the app, website, release notes, or another appropriate channel.
